Post-Conviction

Once a defendant has been found guilty and their direct appeals process exhausted, their remaining options include petitioning the court for post-conviction relief.

Petitions for post-conviction relief are limited to certain constitutional challenges to the conviction, including allegations that the defendant received ineffective assistance of counsel or actual innocence proven by newly discovered scientific evidence.

It is important to consult with an attorney in a timely fashion after the direct appeals process because there is ordinarily a one (1) year statute of limitations for filing for post-conviction relief.
