Vehicular Homicide

In Tennessee an arrest for Vehicular Homicide can result in very severe consequences; you may lose your driver’s license, pay a heavy fine, have your car impounded and go to prison for years.  This type of conviction stays on your permanent criminal record and driving record for life.  With such high stakes, it is crucial that you contact a qualified defense attorney as soon as you are arrested.  There are different types of charges you may be facing, which include:

Vehicular Homicide is the reckless killing of another while driving a car, plane, boat, or other vehicle. The reckless killing must have been caused by the defendant’s:

  • intoxication from alcohol or drugs
  • drag racing
  • ·other reckless conduct that creates a substantial risk of death or serious bodily injury.

Vehicular homicide due to intoxication is a Class B felony, punishable by incarceration for a term between 8-30 years in prison and a fine not more than $25,000. Other vehicular homicide is a Class C felony, punishable by incarceration for a term between 3-15 years in prison and a fine not more than $10,000.

Aggravated Vehicular Homicide involves a defendant who has:

  • had two or more prior DUI or vehicular assault convictions
  • had one prior vehicular homicide conviction
  • had a blood alcohol concentration (BAC) of .20% or more and one prior DUI or vehicular assault conviction.

If convicted of Aggravated Vehicular Homicide, the penalty is increased to a Class A felony, punishable by incarceration for a term between 16-60 years in prison and a fine not more than $50,000.
